Definitions
• "STEIGER DYNAMICS", "SD", "we", "us" and/or "our" mean: STEIGER DYNAMICS LLC.
• "You" or "your" mean: the individual or organization on the invoice.
Your use of the steigerdynamics.com web site (the “Site”) and our services, including phone orders, all purchases, and inquiries, from STEIGER DYNAMICS is governed by the policies, terms, and conditions set forth below. Please read the following information carefully. By using this site or submitting an order for products or services, you indicate your acceptance of, and agreement to be bound by, the Terms of Use set forth below personally or as an agent for any business entity you represent. If you do not agree to these Terms of Use, please do not use this site and please do not submit any orders for products or services.
These Terms of Use apply to the purchase of any products from STEIGER DYNAMICS LLC or any of its subsidiaries. Any attempt to change or supplement this document will be null and void, unless otherwise agreed to in a written agreement by both you and STEIGER DYNAMICS. Our sales representatives are not authorized to make any representations or promises related to any product or services that exceed these Terms of Use and the warranty. Any additional provisions to your purchase must be made in writing signed by an officer of STEIGER DYNAMICS. The Terms of Use are subject to change without prior written notice at any time at STEIGER DYNAMICS’ sole discretion. The section headings below are for reference only. If any term is found to be unenforceable, the remaining terms shall not be affected.
General Terms
Order Acceptance
Your receipt of an electronic or phone order confirmation does not signify our acceptance of your order. STEIGER DYNAMICS reserves the right at any time after receipt of your order to accept or decline your order for any reason. Your order is subject to cancellation by STEIGER DYNAMICS, at STEIGER DYNAMICS's sole discretion.
Product/Service Offerings
STEIGER DYNAMICS continually upgrades and revises its offerings. STEIGER DYNAMICS may revise and discontinue products at any time without prior notice to customers. STEIGER DYNAMICS will ship products that have the same or better functionality and performance of the products ordered, but changes between what is shipped and what is described in a specification sheet are possible. The parts and assemblies used in building STEIGER DYNAMICS products are selected from new parts. Spare parts may be new or like-new.
Performance Information
Performance tests and ratings are measured using specific computer systems and/or components and reflect the approximate performance of STEIGER DYNAMICS products as measured by those tests. Any difference in system hardware or software design or configuration may affect actual performance.
Transfer of Title
STEIGER DYNAMICS retains title to parts and complete systems purchased until the said purchaser pays for items in full or upon receipt at the correct delivery location, whichever occurs later.
Not for Resale
You agree that you are buying STEIGER DYNAMICS products for your own use and not for resale.
Payment Terms
Advertised prices are in U.S. dollars and unless otherwise noted, exclude shipping, handling and any taxes that may be imposed where you reside. Terms of payment are within STEIGER DYNAMICS’ sole discretion, and unless otherwise agreed to in writing by STEIGER DYNAMICS, payment must be received by STEIGER DYNAMICS before STEIGER DYNAMICS’ acceptance of an order. Payment for the products will be made by credit card, or some other prearranged payment method unless credit terms have been agreed to by STEIGER DYNAMICS. STEIGER DYNAMICS accepts cashier checks. All checks are subject to verification. STEIGER DYNAMICS will not accept personal or business checks and or Money Orders for prepay orders. Invoice amounts are due and payable within the period noted on the invoice, measured from the date of the invoice. STEIGER DYNAMICS may invoice parts of an order separately. You agree to pay interest on all past-due sums at the highest rate allowed by law. STEIGER DYNAMICS is not responsible for pricing, typographical or other errors in any offer by STEIGER DYNAMICS and we reserve the unilateral right to cancel any orders resulting from such errors.
Duties/Taxes
Unless otherwise indicated on the invoice, you are responsible for paying all duties/taxes associated with your order.
Processing Time
STEIGER DYNAMICS will always try to build your computer as quickly as possible, but we will never do so at the expense of quality. Orders received before 3:00 PM PST are usually processed the same day for product build. Products are shipped only after build which can take up to 30 days on a standard basis. Your order may be delayed if your ship to address does not match what your credit card issuer has on their file. Due to the many circumstances such as unable to charge your card or verify your address, we cannot guarantee when your order is shipped out. Also if you choose next day air service, it does not necessarily mean you will get it the next day from the order date, it means that you will get it the next day from the date we ship the order. STEIGER DYNAMICS reserves the right at any time after receipt of your order to delay your order for any reason. The customer acknowledges BEFORE purchasing a STEIGER DYNAMICS system that these computers are custom made by hand and the occasional delay does occur. In the event a customer makes a change to the order, STEIGER DYNAMICS is to be given 15 (fifteen) days from the date of order change to build the computer.
Governing Law
This Agreement and any sales hereunder shall be governed by the laws of the USA and the state of California. You agree that any legal action brought against STEIGER DYNAMICS shall be governed by the laws of the State of California without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any arbitration arising from your use of or orders and purchased made on the STEIGER DYNAMICS sites or from STEIGER DYNAMICS shall be in Los Angeles County, California. All actions between the parties related to purchases and sales from STEIGER DYNAMICS shall be resolved by binding AAA arbitration in Los Angeles Count, California.
Shipping Terms
Loss and Damage Risk
Loss or damage that occurs during shipping by a carrier used by STEIGER DYNAMICS is STEIGER DYNAMICS’ responsibility. Loss or damage that occurs during shipping by a carrier used by you is your responsibility. Shipping dates are estimates. You must notify STEIGER DYNAMICS of damaged or missing items from your order within seven (7) calendar days after you receive your product.
COD Shipments
STEIGER DYNAMICS will not accept COD packages.
Refused Shipments
For any product that STEIGER DYNAMICS ships out to the Customer and comes back to STEIGER DYNAMICS as refused delivery, the Customer will be subject to fees. A restock fee of 15% will be applied to the computer system. Also, all shipping fees for sending the package to the Customer and for receiving the package back from the Customer will not be refunded.
Shipping Company
We recommend FedEx, DHL, UPS, or any other shipping company that uses tracking technology.
Shipping Destinations
We ship to any physical address that the shipper/courier can ship to domestically or internationally. We may accommodate Customers who need to have an item shipped to an APO/FPO address or PO Box depending on the circumstances.
Incorrect Shipping Address
We charge the face value that the shipper/courier charges us to reroute your package if you did not enter the address correctly. If your address is wrong, you agree that STEIGER DYNAMICS is authorized to charge your credit card for these fees.
Shipping Delays
“Customer” agrees that STEIGER DYNAMICS will not be liable for shipper's shipping delays. Once an order is shipped, it is up to the shipper courier to deliver the products; we will not be able to stop the shipment once it is shipped. If the shipper/courier loses the package, the shipper courier will put a tracer on the package. Tracers take around 3 days for air packages and 7 business days for ground packages. We will not be able to ship out replacement packages until the shipper courier confirms that the package is lost/will not be delivered to its destination and they will reimburse us. Without confirmation from the shipper courier, we will not know for sure if you will get two shipments if we ship out another one. Another delay is if there is no one to sign for the package. Every package we ship usually requires a signature, if a package is returned to us because no one was available to sign for it or the address was input incorrectly at the time you enter the order, you will be charged again to ship it out a second time.
Change and/or Cancelation of Order Before Shipment
You may change or cancel your order at any time before shipment, however, due to the custom nature of STEIGER DYNAMICS computers, changes and cancellations of orders already charged carries a 5% credit card processing cancellation fee. If an order has already been built in our facility (entered Stage 4) but has not been shipped, there will be a 15% restocking fee which covers expenses for taking the system apart and re-stocking the hardware. STEIGER DYNAMICS reserves the right to waive this restocking fee. In addition, all shipping costs and special order parts are non-refundable. The customer reserves the right to retain special order parts at sale price cost.
30-Day Money Back Guarantee
You may return STEIGER DYNAMICS and COUCHMASTER products purchased from STEIGER DYNAMICS in accordance with STEIGER DYNAMICS’ Return Policy as outlined below. Please keep in mind that you must contact us directly before you attempt to return the product and must return the product to us in its original or equivalent packaging. We are not able to refund any component damaged during return transit because of insufficient packaging.
STEIGER DYNAMICS provides a 30-Day Money Back Guarantee from the date of arrival of the product and the following limited warranty. This limited warranty extends only to the original purchaser, and is subject to the following terms: A refund will be honored ONLY if the product is returned in the same like-new condition as when it was shipped. Any and all damage caused by misuse or neglect will waive any and all customer rights to a refund. Modifying the computer in any way will void all rights to a return. All opened software or software which accompanies the computer is non-refundable, unless otherwise authorized by a STEIGER DYNAMICS representative. All special order parts are non-refundable. In the event of a return, the customer reserves the right to retain all opened software and all special order parts (at the original price). Failure to follow RMA instructions and procedures below properly voids all rights to a return.
Original shipping and handling fees (where applicable) are not refundable. A twenty percent (20%) restocking fee will be deducted from your refund when returning a non-sealed Couchmaster or a custom built-to-order computer. Additional deductions may apply if the item is returned damaged, has visible signs of use (e.g. scratches) or is missing accessories. You must return the merchandise to STEIGER DYNAMICS in its/their original packaging, in as-new condition along with any media, documentation, and all other items that were included in the original shipment, and insure the shipment or accept the risk of loss or damage during shipment. In the event of a customer initiated chargeback, the customer agrees to pay all chargeback fees.The customer also agrees to pay all shipping and handling charges, both to and from STEIGER DYNAMICS. STEIGER DYNAMICS will always work with their customers in order to permit a return without incurring unnecessary costs to our customers, but in the event of a chargeback the customer voids all rights to a return without paying applicable chargeback fees, 20% restocking fee, and shipping and handling both to and from STEIGER DYNAMICS. The Customer voids any and all rights to a chargeback in the event the computer is shipped back to STEIGER DYNAMICS in any condition other than like new. Smoking near a STEIGER DYNAMICS product voids all rights to a refund. If ANY tobacco smoke damage is smelled or seen by a STEIGER DYNAMICS representative, all customer rights to a return are VOID. Refunds are only issued for the sale amount at current selling market value of the component(s) inside the computer, and does not include freight charges. STEIGER DYNAMICS will determine current market value of components with a combination of data from manufacturers, suppliers and online sales sites. Final value of credit will be at STEIGER DYNAMICS' sole discretion.
Limited Warranty
The warranty and remedies set forth below are exclusive and in lieu of all others, oral or written, expressed or implied. No reseller, agent or employee is authorized to make any modification, extension or addition to this warranty.
Warranty Coverage
All STEIGER DYNAMICS systems come with lifetime phone and online support as well as lifetime labor service. For post warranty repair, STEIGER DYNAMICS will not charge any labor costs; however, you are responsible for the current price of part(s) used in repair. These services apply to the life of the original purchase. STEIGER DYNAMICS products also come with the option for either a 1-year, 2-year or 3-year free shipping warranty. To determine which warranty you purchased, please review your packing slip or invoice. The following sections detail the terms of the STEIGER DYNAMICS parts and free shipping warranty.
STEIGER DYNAMICS warrants its products and its parts against defects in materials or workmanship for 3 years (1 year for custom liquid cooling components) from the original date of invoice. During the warranty period, STEIGER DYNAMICS will repair or replace defective parts with new or reconditioned parts at STEIGER DYNAMICS option, without charge to you. All original parts replaced by STEIGER DYNAMICS become the property of STEIGER DYNAMICS. You are responsible for the payment, at current rates, for any service or repair outside the scope of this limited warranty. During your warranty period, STEIGER DYNAMICS will first attempt to diagnose and resolve the problem over the telephone and/or online remote access. If we determine that the problem is with a defective component covered by your warranty, we will then either: have you send your product back to our facilities for repair or send you a part to replace the defective component.
If STEIGER DYNAMICS determines that the problem with the product is not covered by the warranty, we will inform you of alternative solutions that may be available to you. This limited warranty covers only normal use of the computer. STEIGER DYNAMICS shall not be liable under this warranty in any of the following circumstances
• Any damage or defect resulting from actions that are beyond STEIGER DYNAMICS’ control, such as: impacts, liquids, fire, flood, rain, lightning or other disasters (e.g. nuclear war, zombie apocalypse, epidemic, alien occupation, or armed insurrection) or improper electric current (SURGE PROTECTORS ARE REQUIRED)
• Any damage or defect resulting from misuse, abuse, neglect, improper shipping, installation or mishandling
• Any damage or defect resulting from service or alteration by anyone other than an authorized STEIGER DYNAMICS representative without express permission from STEIGER DYNAMICS. This includes but is not limited to overclocking of ANY kind. STEIGER DYNAMICS understands that from time to time persons may wish to modify their computers. Computers may be modified at your own risk. Any damage resulting from the modification of the computer is the user's responsibility. We ask that you obtain STEIGER DYNAMICS guidance before making any modifications by calling toll free 1-855-915-9000 or by email (support@steigerdynamics.com).
• Any damage or defect resulting from failure to remove blue and/or grey packaging inside of computer
• STEIGER DYNAMICS has not received full payment for the product sold.
• The parts serial numbers have been tampered with and/or are nomore clearly identifiable. All seals in and around the system and its components must be untampered with and clearly identifiable.
• The customer is unable to present the original invoice when requested by a STEIGER DYNAMICS representative. Failure to comply will void any and all customer rights to warranty service. In order to qualify for warranty service, the customer must retain a copy of the original invoice.
Limited Warranty for Accessories
Any and all parts which are not a part of the computer system such as monitors, speakers, peripherals, accessories, printers, mice, keyboards, etc. are NOT covered by this warranty. Instead, the buyer should seek warranty service from the original manufacturer of these accessories.
Limited Warranty for Custom Liquid Cooling
Custom liquid cooling, or liquid cooling which involves the graphics card(s), is not sealed by the original manufacturer. In the event of a custom liquid cooling leak, STEIGER DYNAMICS LLC is liable for the repair of the liquid cooling system itself and for other components within the system which are damaged as a result of leak for only one year. Custom liquid cooling components are warranted for ONLY one year. The limited warranty and liability period for custom liquid cooling components cannot be increased beyond one year under any circumstances. Use of 3rd-party replacement parts, coolants, or coolant additives will void this warranty. STEIGER DYNAMICS LLC will not pay for warranty service performed by a non-authorized repair or diagnostic service and will not reimburse the consumer for damage resulting from warranty service performed by a non-authorized repair service. No responsibility is assumed for any special incidental or consequential damages due to a defective liquid cooling product. No other warranty, written or oral, is authorized by STEIGER DYNAMICS LLC.
Maintenance Requirements
In order for the computer to be covered by warranty, basic and proper computer maintenance must be performed by the buyer. In accordance with this condition, the computer must be kept free and clear of any and all dust and other foreign contaminants. Proper removal of dust entails the use of a static free dust blower (such as a computer-safe dust blower can) while the machine is off and whenever is necessary for the computer to operate free of dust. For units which have liquid cooling, liquid levels must be maintained at levels which permit the continuously safe operation of the liquid cooling system. We recommend custom liquid cooling maintenance to be performed ONLY by STEIGER DYNAMICS or by a qualified/certified IT professional every 12
Replacement of Defective Parts
Occasionally due to changes in industry standards, a part must be replaced with a comparable part rather than the same part. It is at the sole discretion of STEIGER DYNAMICS when a part must be replaced by a comparable part rather than the original model number. In the unlikely event that this comparable part is incompatible with other parts within the system, it is the responsibility of STEIGER DYNAMICS to replace ONLY the damaged part EVEN IF the act of replacing this part does not result in a fully operational computer. It then becomes the buyer's responsibility to cover the cost of applicable parts in order to render all parts within the machine fully compatible and thus the computer itself operational. For example, if a motherboard must be replaced by a different chipset because the original chipset is no longer in production, the processor will also need to be replaced. In this example, the cost of the motherboard is the responsibility of STEIGER DYNAMICS but the cost of the processor is the responsibility of the customer. STEIGER DYNAMICS does not anticipate problems of this nature occurring, and we have chosen the most future-proof parts possible for this exact reason. Replacement parts are warranted for thirty (30) calendar days or the remainder of the warranty period, whichever is longer. Any additional purchases or upgrades will not extend this product warranty.
International Orders
The warranty applies to STEIGER DYNAMICS products shipped to any country outside of the United States, provided that you are responsible for paying all freight charges incurred in shipping, importing/exporting, receiving replacement parts and for arranging and paying for the shipment of any defective part(s) back to STEIGER DYNAMICS. All international customers are responsible for all customs duties, VAT and other associated taxes and charges. For international customers, duties and applicable taxes are not calculated or charged by STEIGER DYNAMICS. International customers are solely responsible for any shipping costs, as well as duties and/or taxes that may be incurred from the international transit of any part or system for repair. You acknowledge that the purchased goods licensed or sold under this Agreement, and the transaction contemplated by this Agreement, which may include technology and software, are subject to the customs and export control laws and regulations of the United States, and may also be subject to the customs and export laws and regulations of the country in which the products are manufactured and/or received. Further, under United States law, the goods shipped pursuant to this Agreement may not be sold, leased, or otherwise transferred to restricted countries or utilized by restricted end-users or an end-user engaged in activities related to weapons of mass destruction, including activities related to the design, development production or use of nuclear weapons, materials, facilities, missiles or the support of missile projects, and chemical or biological weapons.
RMA Policy and Procedure for Computer Systems
Should you wish to initiate a product return for any reason, please follow the RMA steps as outlined below:
1. You obtain RMA number: All returns require the customer to obtain a RMA number by calling toll free 1-855-915-9000 or by email (support@steigerdynamics.com).
2. You ship to us: You must ship the merchandise within fourteen (14) calendar days of receiving your RMA number. All returns require the customer to include a proof of purchase, ideally a copy of the original invoice. Moreover, all returns require the customer to include a note with full name, address, RMA number, daytime phone number, and problem description.Ship the package to STEIGER DYNAMICS, Attn. RMA Department, 1590 Marshall St, Redwood City, CA 94063, USA. STEIGER DYNAMICS will not be responsible for any damages incurred during shipments to STEIGER DYNAMICS. Pack the computer in its original box or a well-protected box. The box must be able to handle a weight of 60-80 lbs. There should be a minimum of 3” of space on all six sides of the computer.The 3” space shall be fitted with block foam material. Make sure the material will absorb an impact if dropped. We do not recommend foam popcorn/peanuts, newspaper, pieces of cardboard, blankets etc. These materials tend to shift in the box and allow the computer to move and make contact with the sides of the box. Use heavy-duty 3” packing tape rated atleast at 60 lbs to seal the package. Do not use masking tape - the driver will not accept the package. STEIGER DYNAMICS will only pay RMA shipping costs if your return is within the warranted period of the “Free Shipping Warranty” option you selected at time of purchase. Otherwise, you will be responsible for shipping charges to STEIGER DYNAMICS.
3. We repair: Upon receiving the computer, STEIGER DYNAMICS will repair or replace your computer or parts (at STEIGER DYNAMICS’ discretion) and will ship it back to you within 5~10 business days.
4. We ship back to you: STEIGER DYNAMICS will only pay RMA shipping costs if the incident is within the warranted period of the “Free Shipping Warranty” option you selected at time of purchase. Otherwise, you will be responsible for shipping charges from STEIGER DYNAMICS to you and once your computer is repaired, you will be billed for return shipping charges. You must pay this fee before we can ship your computer back to you.
IMPORTANT: Before you ship a product to us or before you replace a part, make sure to back up the data on the hard drive(s) and any other storage device(s) in the product(s). Remove any confidential or personal information and removable media such as CDs or DVDs. We are not responsible for any of your confidential or personal information; lost or corrupted data; or damaged or lost removable media.
RMA Policy and Procedure for Pre-Exchange (Parts only)
Should you wish to initiate an exchange of a defective part, please follow the RMA steps as outlined below:
1. You obtain RMA number: Obtain an RMA number by calling toll free 1-855-915-9000 or by email (support@steigerdynamics.com). You will need to provide a valid credit card number as a deposit guarantee when the RMA number is issued.
2. We ship to you: Once approval has been obtained on your credit card, the part(s) will be shipped from STEIGER DYNAMICS to you. STEIGER DYNAMICS will only pay RMA shipping costs if the incident is within the warranted period of the “Free Shipping Warranty” option you selected at time of purchase. Otherwise, you will be responsible for shipping charges from STEIGER DYNAMICS to you, and you must pay shipping charges before we can ship the replacement part(s) to you.
3. You return defective parts: You must ship defective part(s) back to STEIGER DYNAMICS within 15 days to avoid charges to your credit card. If such charges are incurred, the shipped part(s) will be billed at the then current price. Individual parts must have sufficient protection to prevent shipping damages. Use anti-static bag and proper boxed packaging. Never just use an envelope since individual parts are sensitive to being dropped or crushed. Ideally, you should use the packaging of the replacement part that you received from us.
IMPORTANT: Before you ship a product to us or before you replace a part, make sure to back up the data on the hard drive(s) and any other storage device(s) in the product(s). Remove any confidential or personal information and removable media such as CDs or DVDs. We are not responsible for any of your confidential or personal information; lost or corrupted data; or damaged or lost removable media.
Limitation of Liability
STEIGER DYNAMICS does not accept liability beyond the remedies set forth herein, including any liability for products not being available for use, for corrupted or lost data/software. STEIGER DYNAMICS will not be liable for lost profits, loss of business or other special, indirect or punitive damages, even if informed of the possibility of such damages, or for any claim by a third party. You agree that for any liability related to the purchase of products or services, STEIGER DYNAMICS is not responsible for any amount of damages above the original dollar amount you paid for the purchase.
STEIGER DYNAMICS has not tested its products for use in high-risk activities including any life sustaining, chemical, or mission critical use. STEIGER DYNAMICS WILL NOT HAVE ANY LIABILITY FOR ANY DAMAGES ARISING FROM THE USE OF THE PRODUCTS IN ANY HIGH RISK ACTIVITY, INCLUDING THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL, MEDICAL SYSTEMS, LIFE SUPPORT OR WEAPONS SYSTEMS.
